MillerFoto Privacy, Security, Communications, Data Collection and Usage Policy

1) Definitions

“MillerFoto” means MillerFoto of Kenner, LLC (including services provided under the MillerFoto and Big Cheese Photos brands).

“Client” means any individual or entity purchasing, requesting, hosting, or receiving services from MillerFoto, including schools, school districts, sports leagues, teams, businesses, nonprofits, and individuals.

“Client-Provided Data” means information the Client (or its authorized representatives) provides to MillerFoto to deliver the contracted services.

2) Core Privacy Commitments

Student and family information is not sold, rented, leased, or traded.

Client-Provided Data is used only to deliver Client-contracted photo services (and related support), not for unrelated third-party marketing.

We collect and use only the minimum information necessary to perform the services.

 

3) What We Collect (Minimum Necessary)

Depending on the service, we may receive:

Roster / participant information (e.g., name, grade, team, teacher/homeroom, participant ID, and identifiers needed for accurate exports).

Parent/guardian contact information (email and/or mobile number) only if provided for access, service updates, and support related to the Client’s photo program.

Order fulfillment information (shipping address and order details) only when an order is placed and shipped.

Images captured during the event/session and related metadata needed to deliver the service.

 

4) How We Use Data (Permitted Uses Only)

Client-Provided Data may be used to:

Photograph participants and deliver galleries/images

Produce IDs / ID cards (when requested)

Provide yearbook/admin exports (when requested)

Enable secure viewing and ordering

Deliver orders and provide customer support

Handle retakes, replacements, and reprints (when requested)

 

5) Consent to Communications (Email, Calls, Texts)

By being photographed, creating an account, and/or providing a telephone number, you consent to receive communications about your photo services (including access information, reminders, ordering help, delivery updates, and support) at that number and, where provided, at numbers associated with your household/participant record.

Communications may be sent by or on behalf of the Client and MillerFoto, and may include calls and text messages generated using automated systems and/or prerecorded messages, where permitted by law.

Message & data rates may apply.

You may opt out of non-essential communications at any time (see Section 6). Order- or support-critical messages may still be sent when necessary to fulfill an active order or respond to a request.

 

6) Opt-Out

Families may opt out of non-essential text/email reminders using the instructions in the message (e.g., “STOP” for texts where applicable) or by contacting us directly.

Opting out of reminders does not prevent us from sending required service communications needed to fulfill an order, respond to support, or comply with Client instructions and legal obligations.

 

7) FERPA, COPPA, and Student Data Privacy Agreements

We respect applicable student privacy requirements, including FERPA and COPPA, where applicable to the service and Client relationship.

Where a Client participates in or requires a student data privacy framework (including NDPA/SDPC or similar agreements), MillerFoto will support compliance obligations applicable to the contracted services.

 

8) Client Control (Including “No Media / Do Not Publish”)

The Client controls what data is provided to MillerFoto, which services are delivered, and which records/images are included or excluded from exports and deliverables.

“No Media / Do Not Publish” restrictions are managed by the Client. MillerFoto relies on the Client’s written lists/instructions and does not police Client-controlled publications beyond those instructions.

 

9) Yearbooks and Client Publications

For yearbooks and Client publications, MillerFoto prints/produces based on materials submitted and approved by the Client.

The Client is responsible for content selection and approvals, including names, captions, identification details, inclusion/exclusion decisions, permissions/releases, and compliance with Client policies and applicable laws.

0) Where Data Is Stored

MillerFoto does not maintain Client data on a local on-prem office network server for ongoing access.

Files are stored and managed using secure cloud storage (including Google Drive / Google Workspace) and/or trusted production/fulfillment partners as needed to deliver ordered products.

 

11) Third-Party Production & Fulfillment Partners

MillerFoto may use vetted partners for printing, specialty products, and direct-to-home shipping.

Partners receive only the minimum information necessary to produce and ship ordered items and are not permitted to use Client/family data for unrelated marketing or resale.

Partner details may be provided to the Client upon request for review.

 

12) Security Practices

We use practical safeguards designed to reduce risk, including:

Encrypted connections for online services and file transfer

Two-factor authentication (2FA) where available

Role-based access controls

Secure handling procedures for rosters and exports

No system can guarantee zero risk, but our goal is to limit access and protect what Clients entrust to us.

 

13) Retention and Deletion

We retain data only as long as needed to deliver Client services, support ordering/reorders, and provide customer service and fulfillment. If a Client requires a specific retention schedule, we can align where feasible.

 

14) Additional Terms Available Upon Request

Additional terms, data-handling documentation, or Client-specific privacy addenda may be provided upon written request.
